[1] The property that is the subject of this appeal is a rural recreational 10.25 acre lot with a 900 square foot cabin in the Columbia Valley. The property has no legal road access and is accessed via adjacent private land without a formalized easement in place. The property does not have electricity, telephone or other utilities. The issue is to determine whether the assessed value of $112,300 reflects the market value of the property as of July 1, 2009.
[2] The only evidence before me is an appraisal report authored by Jonathon O’Grady of BC Assessment. Mr. O’Grady analyzes three sales of rural recreational property in the Columbia Valley occurring in 2009, and adjusts for access, location, and improvement type, age, size and quality. He indicates the negative $15,000 adjustment applied to the sales for the lack of legal access at the subject was based on discussions with a fee appraiser who had valued easements and expropriations in the Columbia Valley. The sales indicate a range of value for the subject of $120,000 to $220,500. Placing most weight on the most comparable sale, Mr. O’Grady estimates the market value of the subject as of July 1, 2009 at $120,000. The Appellant has not provided the Board with any market evidence with which to estimate market value of the subject or to challenge the conclusions of Mr. O’Grady.
[3] The Assessor asks the Board to confirm the 2010 assessed value of $112,000 on the basis of Mr. O’Grady’s evidence.
[4] On the basis of the only market evidence before me, I conclude that the 2010 assessment reflects the market value of the property as of July 1, 2009.
