  • This application is provided as a public service and for information purposes only (the “application”).  It will NOT generate an appeal to the Board.
  • The Ministry of the Attorney General (the “Province of British Columbia”) is responsible for the Board and any reference to the Board incorporates the Ministry.
  • While this application provides general guidance based on the questions you answer and information you provide.  It is not intended to provide specific advice or recommendations and may not cover every detail of your concerns as assessment appeals and property assessment related issues can be complex.  As a result, you may wish to obtain expert valuation or legal advice.
  • The evaluation provided through this application is NOT a decision of the Board.
  • Any outcome of the evaluation process provided in the application cannot be used or relied upon as part of your case if you file an appeal to the Board and the appeal proceeds to adjudication.

USER AGREEMENT
Every person who accesses this application (the “user”) agrees to the terms of use in this document and to any amendments made from time to time by the Board.   Your use of the application constitutes consent and acceptance of these Terms of Use. The Board may change or update these Terms of Use at any time without notice. Please review the link on a regular basis for any changes. If you continue to use this service after the Terms of Use have changed, you will be deemed to have accepted and consented to any changes.

PRIVACY 
The application does not collect specific personal information about users without their consent.  Any personal information provided through the application is subject to the Province of British Columbia’s privacy policies.  The Board may collect general data about users’ use of the application to better understand general user trends to improve web performance, web services, and website maintenance.

The Board will not be responsible for any damages you or any third party may suffer as a result of the transmission of potential confidential information that you make to any party through the internet email links provided on the Board’s website. 

OWNERSHIP AND PERMITTED USES
The application and all of the information, documents, resources, tools, and other materials published on the application (together, “Materials”), are owned by the Board or its licensors and are protected by copyright, trademark and other laws. Nothing in this Agreement or your active use of the application gives you any intellectual property rights in the application or the content you access. 

Except as expressly permitted in these Terms of Use, you must not reproduce or distribute, or permit or authorize any other person or entity to use, reproduce or distribute, any of the Materials in any form without the prior written consent of the Board. Use of Materials on the application can be subject to conditions set by courts, government, or other bodies claiming intellectual property rights relating to the Materials.

By using the application you agree not to a) violate any law, rule, or regulation, b) incorporate any or all Materials into another website by masking their origin or source through framing, re-use of search processes, or any other means of creating confusion and misrepresenting the fact that the Materials come from the application; c) any use of the Materials via automated mechanisms, in particular for bulk downloading of any or all Materials; d) interfere with the Board’s website, including our services, computer systems, servers, networks, software, hardware, or equipment; e) harm, threaten, abuse, harass, breach a person’s privacy, or act in a manner that is hateful, discriminatory, or wrongful in some other way; f) misrepresent your affiliation with a person or agency; g) impersonate a person or agency, including the Board.

The Board reserves the right to block, at its discretion and without prior notice, any user from accessing the application if the user misuses the website, uses it for illegal purposes, or violates these Terms of Use. 

DISCLAIMER 
You use the application at your own risk.  The Board assumes no responsibility for any errors or omissions within the application. The Board makes no representation or warranty of any kind, either express or implied, whatsoever with respect to the application, including, without limitation, warranties on merchantability, accuracy, adequacy, timeliness, completeness of the information and Materials, title, fitness for a particular purpose, and non-infringement. Under no circumstances will the Board be held liable for any loss or damages (including any type of damages) which may be attributed to the reliance on and use of the application or to the inability to use the application or Materials, whether or not the damages were foreseeable. 

LIMITATION OF LIABILITY
Under no circumstances will the Board and its employees, agents, service providers and independent contractors have any responsibility or liability for any loss or damage whatsoever (including without limitation direct, indirect, special, incidental, consequential, punitive, exemplary or other damages, and including without limitation to any loss of profit, costs, expenses, harm to business, business interruption, reputation, loss of information or programs or data, loss of savings, loss of revenue, loss of goodwill, loss of tangible or intangible property, legal fees or legal costs, wasted management or office time or damages of any kind whatsoever), whether based in contract, tort, negligence or any other legal basis, arising out of or in connection with the application, the website, any linked website (including without limitation any damages suffered as a result of the use, inability to use, failure of, or any omissions or inaccuracies in this website, any linked websites or linked social media platforms, or any of the services or content of the foregoing), even if Board has been specifically advised of the possibility of such damage or loss, or if such damage or loss was foreseeable. Regardless of whether such losses are deemed to be direct or indirect damages, the Board is not liable to you for any damages relating to a loss of your data loss and you are responsible for backing up your data.

The Materials on the application have been collected and prepared solely for informative purposes. They are in no way legal advice. Although the application may provide information concerning potential legal issues, it is not a substitute for legal advice. You should not rely on the application as a source of legal advice.

APPLICABLE LAW
Use of the application and these Terms of Use are governed by the federal and provincial legislation in force in the Province of British Columbia, Canada. Any legal action against the Board with regards to application use shall be brought exclusively before the courts of the Province of British Columbia
